Shura Council Approves Cancellation of Cases before Sharia Courts after 60-Day Period instead of 6 Months

Bahrain Mirror: The Bahraini Shura Council approved a bill amending Article 34 of the Code of Procedures before the Sharia Courts by amending the duration of the cancelled cases from 6 months to 60 days. Article 34 stipulated that "the case shall remain cancelled for six months."

Shura members pointed out that the previous period is considered long and affects the stability of legal positions. Therefore, the rights of the litigants are disrupted. They added that the purpose of the bill is to regulate the process of litigation before the Sharia courts and to expeditiously adjudicate on cases related to marriage, divorce, inheritance, wills and endowments (Waqf).

The Minister of Shura Council and Parliamentary Affairs, Ghanim Al-Buainain, explained that this regulatory procedure is laudable, especially as there are pending cases in the Islamic Sharia courts due to the ligitants' inaction and there are lawsuits that even remain outstanding for years.
